This Document sets out the entire agreement between the Seller and Owner of embeddedGLOW.com, called below Website, and the Buyer of any product offered at the Website or eBay, considering it as a Contract between these Parties. This Contract is considered done upon placing a purchase order by the Buyer, and supersedes any prior written or oral agreement between the Parties. The Buyer acknowledges that in entering into the Contract, it has not relied on any representation not expressly set out in the Contract.

This Document also determines the use of this Website by any Visitor considering it as a Contract between the Website Owner and the Visitor. This corresponding part of the Contract is considered done upon visiting this Website.

If any provision of these Document is held to be illegal, void or unenforceable, the legality, validity and enforceability of the remainder of this Document is not to be affected.

Limitation of Liability

The Seller/Website Owner is not liable to the Buyer/Visitor for: (a) any loss of profit, business contracts, opportunity, goodwill, revenue, anticipated savings, expenses, costs or similar loss; and/or (b) any indirect, special or consequential loss or damage, and in the case of either paragraph (a) or (b) above whether caused by negligence, breach of contract, tort, or breach or statutory duty of the Seller/Website Owner arising out of or connected with purchasing and/or using products or information from this Website or corresponding eBay listings or visiting this Website. This extends to any parties that might be connected to the Buyer/Visitor.

The Seller is not responsible for any malfunction of or damage to any Product sold that is caused by incorrect connection or use out of its performance limits or intended use, or if the Product suffers external damage in any way.

The Website Owner/Seller makes no representations or warranties of any kind, about the completeness, accuracy, reliability, suitability or availability with respect to the Website or the Information, Products, services, or related graphics contained on this Website or corresponding eBay listings for any purpose.

This Website provides links to other websites, the nature, content and availability of which are not under the control of the Website Owner. The inclusion of any links does not imply a recommendation or endorsement of the views expressed within them.

If Product is sold any possible liability of the Seller to the Buyer is limited to the price of the Product related.

Products' modifications and substitutions

The Seller reserves the right to substitute Products substantially equivalent to those ordered. The Buyer agrees that it is their responsibility to test all shipments of Products so as to ensure that they are suitable for Buyer's requirements.

Products' intended use

Any Product subject to sale by the Seller is intended for regular use only. It is not intended or suitable for any medical, safety or mission-critical applications.

Warranty

Being DIY-related all Products subject to sale by the Seller unless otherwise noted are not covered by warranty.

All Products subject to sale by the Seller are tested before shipping so they are guaranteed to be shipped in working order.

Working hours

Unless otherwise noted orders are received on 24/7 basis. If applicable, vacation notification is published on every page.

Payment and Price

Payment is due prior to shipment of any Product.

Payments are only received via PayPal.

Prices are in Euro (€, EUR). Any exchange rate displayed or price in different currency is estimated only and may differ from what PayPal actually calculates.

The price of any Product is exclusive of delivery, packaging, insurance, etc. which may be charged extra. VAT is not added to the price, VAT number is not available. Commercial invoices will not be issued, please use the Paypal receipt instead.

The Seller reserves the right to adjust the price at any time.

Shipping

Shipping is worldwide.

Shipping is done by default via Registered Priority Airmail. In addition to the default shipping method all major carriers can be used by request. Not all carriers serve all destinations.

Tracking number is always provided unless unregistered mail is requested by Buyer. If unregistered mail is used, the Seller cannot advise delivery time and cannot be held responsible for any delivery problem, including loss of order.

Airmail tracking is possible only while the package is still in the country of origin or when it has reached the destination country. Tracking updates are unavailable while the package is between those two areas. Tracking info becomes available 1-2 days after actual items handover.

Shipping charges are applicable to all orders. Shipping price is subject of change by carrier. It is not guaranteed that Website calculates most recent carrier price. In case of discrepancy the Buyer is noted before shipping.

Shipping occurs when Products are handed over by the Seller to carrier company. As shipping is always done by a third party it is completely out of Seller's control. Delivery times may vary upon destination, weather conditions, security measures, etc. Following typical registered priority airmail delivery times are estimated only. The Seller is not liable for any possible delay in the delivery process.

Products with cleared payment are shipped within 3 (three) business days unless otherwise noted.

The Buyer is solely responsible for customs duties or any other charges that may apply.

The Buyer is solely responsible for shipping address accuracy. PayPal-supplied shipping addresses are not in use.

If the carrier returns to the Seller a package as undeliverable no matter what the reason is, the Seller will refund to the Buyer the price paid less shipping costs. Package is considered not delivered after waiting for a reasonably long period of time and the Seller being convinced that every possible delivery effort is made.

Any shipping/delivery-related claim by the Buyer must be advised to the Seller within 3 (three) days of problem discovery otherwise it will be considered void.

Order cancellation and returns

Any order can be cancelled at any time by the Seller. Any order excluding custom orders can be cancelled by the Buyer at any time before it is shipped. In case of non-custom order cancellation full refund is issued.

Any Product which is unused, unaltered, undamaged, and unsoldered can be returned in its original content within 7 (seven) days from the date of acceptance by the Buyer. Prior Return Merchandise Authorization (RMA) is needed. Returns are at the sole cost of the Buyer. Upon returned Product arrival the Seller checks it and if above conditions are met issues a refund less original shipping cost.

Privacy policy and use of cookies

This privacy policy is applied immediately when any Visitor and/or Buyer enters this Website or commits to buy from a corresponding eBay listing.

No prior registration is needed for placing orders. Information required to place an order is as little as possible: Buyer's email address and delivery address. This information is stored by the Website in order that the Buyer is able to receive order notifications and check their order status and history. All this information is password-protected and is available to the corresponding Buyer only. This information is used only for order-management purposes. Based on Buyer's consent this information is stored for unlimited period of time or it is stored only while corresponding order is processed. Buyer can delete any order information or request its deletion at any time after order is shipped.

Buyer's e-mail address is used for sending order notifications. Based on Buyer's consent this address can be used as login for checking order status and history and for sending promotional, custom or discount codes, new product announcements, vacation announcements, etc. as well. This can be changed at any time by Buyer.

The Seller will not publish or reveal any information acquired in consequence of placing orders except information which is bound to disclose by law.

Because it is all processed by a third party, no payment-related or credit-card-related information is available to, or processed or stored by the Seller and/or this Website.

Cookies are used only to identify sessions, i.e. when some products are placed in the shopping cart, they will still be there, if Website is revisited within 24 minutes. These essential technical cookies are small pieces of text stored in Visitor's web browser containing only a session ID, which is a number like for example a86b10aeb5cd56434f8691799b1d9360. They expire in 24 minutes and cannot be used for user identification or any marketing-related purposes. This Website cannot operate properly without setting this type of essential technical cookies.
